Employees have the right to be absent from work for up to ten working days if this is necessary to organise needs-based care for a close relative in need of care in an acute care situation or to ensure nursing care during this time (short-term prevention of work).

In addition, employees must be released from work in whole or in part if they care for a close relative in need of care in a home environment (care leave).

As soon as employees announce to their employer that they wish to take time off work due to short-term incapacity for work or as care leave, the employer may not terminate the employment relationship. However, the protection against dismissal is limited in time. It begins no more than twelve weeks before the announced start and ends at the end of the short-term absence from work or care period.
In special cases, termination may exceptionally be declared permissible. The declaration of admissibility is made by the highest Land authority responsible for occupational safety and health. In Schleswig-Holstein, this is the State Occupational Safety and Health Authority at the Unfallkasse Nord.
Without a letter of approval from the competent authorities, termination is legally invalid in the defined cases.
