If you have a biologically determined variant of sexual development and this is confirmed by a medical certificate, you can change the sex entry in your birth register and your first names at the registry office.

You can then choose the gender entry male, female or diverse or leave the gender entry open in the register.

The following must be noted:

• The change of the gender entry and first names can only be carried out for Germans within the meaning of the Basic Law, stateless persons, homeless foreigners, foreign refugees or persons entitled to asylum.
• A medical certificate confirming a variant of sexual development for biological reasons (intersexuality) shall be presented; i.e. they cannot be biologically assigned to either the female or the male sex.
• The medical certificate may be replaced by an affidavit of the person concerned if he or she does not have a medical certificate of medical treatment and if, as a result of the treatment, the existence of a variant of sexual development can no longer be established or can only be demonstrated by an unreasonable examination.
• For an incapacitated person and a child under 14 years of age, the application can only be made by the legal representative; a limited person with a limited legal license requires the consent of the legal representative.
• This option is not available for people with a transsexual character. The change of name and gender entry in this group of persons is governed by the Transsexual Act.
